The text below applies to all Direct To Customer (D2C) activities of Jolo Fashion Group , hereinafter referred to as: “ JFG ” or “ we ” .

1.1 The conditions below are used by Jolo Fashion, established and having its office in Made, as well as by the current group companies Jolo Eurofashion Made BV, Jolo Fashion GmbH, Brand Works BV, B.Nosy Kidswear BV, Moodstreet BV, Bellaire BV, NoNo BV, Flo BV, LC Kidswear BV, Brand Works Holding II BV, Tygo&vito Kidswear BV, SuperRebel Kidsgear Company BV, Ko & Flo BV, and all companies affiliated with the aforementioned companies now and in the future.

1.2 These terms and conditions apply to all existing D2C websites and future D2C websites of the group companies mentioned under 1.1. Below is an overview of the current D2C websites:

Privacy statement & Cookie policy

JFG processes personal data in the context of its D2C activities. This Privacy Statement & Cookie Policy (hereinafter: “ Statement ”) has been drawn up to inform customers, suppliers, visitors to the websites and other persons who contact JFG (for example via the contact form on the JFG websites) about the processing of their personal data by JFG.

JFG is responsible as referred to in Article 4 of the General Data Protection Regulation (GDPR) for the processing of personal data as shown in this Statement.

Personal data that we (JFG) process

JFG processes the following personal data of the categories of data subjects mentioned in the introduction to this Statement:

First and last name
Sex
Date of birth
Address data
phone number
E-mail address
Employer and position (in case of suppliers)
IP address
Information about your activities on our websites
Internet browser and device type
Bank account number

JFG obtains this personal data because you provide it to us when you use our services, or because it is collected when using our websites.

The personal data will be included in the customer base of the group companies mentioned in 1.1.

You are under no circumstances obliged to provide your data to JFG. However, if you decide not to provide your data, we cannot (completely) offer our services to you.

Special and/or sensitive data that we process

JFG does not intend to process special and/or sensitive personal data, or to collect personal data from website visitors who are younger than 18 years of age. However, we cannot check whether a visitor is older than 18. We therefore recommend that parents be involved in their children's online activities to prevent data about children from being collected without parental consent. If you are convinced that we have collected personal information about a minor without this consent, please contact us via our customer service and we will delete this information.

For what purpose and on what basis do we process personal data?

JFG processes your personal data for the following purposes:

Handling your payment
Sending our newsletter and/or advertising brochure
To be able to call or email you if this is necessary to provide our services
To inform you about changes to our services and products
To offer you the opportunity to create an account
To deliver goods and services to you
Providing our websites
Obtaining information about the use of our websites

We may use your personal data for the above purpose because you have given us permission to do so, because this is necessary for the execution of our agreement with you and/or because this is necessary for the representation of our legitimate interests.

Automated decision making

JFG does not make decisions based on automated processing on matters that could have (significant) consequences for people. This concerns decisions that are taken by computer programs or systems, without a human being involved (for example an employee of JFG).

How long we keep personal data

JFG does not store your personal data for longer than is necessary to achieve the purposes for which your data is collected. In general, we apply the following retention periods for personal data:

We store customer data for up to 2 years after the end of the customer relationship;
Messages sent via the online contact form will be deleted after the message has been processed;
We keep tax data for up to 7 years after collection of the data.

Access to your personal data

JFG handles your personal data with care. This also means that your personal data (internally) is only accessible to our employees to the extent necessary for the performance of their work for the purposes stated in this Statement.

JFG will only provide your personal data to third parties if this is necessary for the execution of our agreement with you or to comply with a legal obligation. For the execution of our agreement with you, you can, for example, think of the processors we engage, such as our software suppliers. Provision on the basis of a legal obligation may, for example, include the provision of your data at the request of, for example, the judiciary or the tax authorities. When providing personal data to third parties, JFG will ensure that, where possible, it has taken appropriate safeguards to protect your personal data.

In principle, we do not process your personal data outside the European Economic Area (EEA). If this is the case, we will make every effort to comply with the conditions set by law.

Cookies, or similar techniques, that we use

To help you better and make targeted offers, we use cookies to improve your user experience on the websites. Cookies are text files that your device or browser stores when you visit our websites. JFG may also use techniques similar to cookies, such as tracking pixels, flash cookies, Javascripts, tags and web beacons. We classify these techniques under the term cookies.

By using our websites, you consent and agree to the use of cookies and the storage of personal data.

We use necessary cookies on our websites. These are cookies that are necessary for the websites to function. Your prior consent is not required for the use of necessary cookies.

View, adjust or delete data

You have the right to view, correct or have data deleted. This means that you can submit a request to us to send the personal data we hold about you in a computer file to yourself or a third party. You can send a request for access, correction or deletion of your personal data or a request for withdrawal of your consent or objection to the processing of your personal data to our customer service. To ensure that the request for access has been made by you, we may ask further questions to verify your identity. We will respond to your request as quickly as possible, but within four weeks.

How we protect personal data

JFG takes the protection of your personal data seriously and takes appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure and unauthorized changes. If you have the impression that your data is not properly secured or if there are indications of misuse, please contact us via our customer service.

Amendments

JFG may change or replace this Statement at any time. For this reason, we advise you to consult this Statement regularly so that you are aware of the latest status. In the event of substantial changes, JFG will notify you of those changes.
